Banks v. City of Rockford - Obtained summary judgment in wrongful death action in which Plaintiff alleged that a police officer acted willfully and wantonly during a traffic stop, including the use of deadly force. The decision was affirmed on appeal.
Barbee v. Macon County Highway Department - Obtained summary judgment in Title VII action where Plaintiff alleged same-sex harassment by a co-worker and retaliatory termination because of his complaints.
Burger v. Macon County - Obtained pre-discovery dismissal in § 1983 action where Plaintiff alleged that the County State’s Attorney terminated her employment in violation of her First Amendment right to association. The dismissal was affirmed on appeal with the Seventh Circuit holding that in Illinois a County is not liable under § 1983 for the employment decisions of its State’s Attorney.
Costello v. Oglesby Ambulance Service - Obtained pre-discovery dismissal in wrongful death action based on EMS System’s Act immunity where Plaintiff alleged the Defendant’s paramedics’ acts and omissions during a inter-hospital transfer caused the decedent’s death.
D'Amato v. Ameristar Casino East Chicago - Obtained summary judgment in personal injury action where Plaintiff alleged that she slipped and fell in water on the floor of the Defendant’s restroom sustaining a femur fracture on the basis that the Defendant had no notice of the dangerous condition of the restroom.
Hopfinger v. Fletcher - Obtained summary judgment on behalf of police chief in § 1983 action where Plaintiff, an administrative assistant, alleged that the police chief terminated her employment in retaliation for speech protected by the First Amendment.
Lizak v. City of Campton Hills - Obtained pre-discovery dismissal in § 1983 wrongful death action in federal district court where Plaintiff alleged the Defendant police officers deprived the decedent of his due process rights by releasing him from custody on foot while he was intoxicated. Following dismissal of the federal claims, Plaintiff re-filed state law claims in the Circuit Court of Kane County. Successfully obtained pre-discovery dismissal of state law claims pursuant to various defenses afforded by the Illinois Tort Immunity Act.
Morgenstern v. City of Highland Park - Successfully defended a defense verdict on appeal in a personal injury action where Plaintiff slipped and fell on snow and ice in the public way.
Rogers v. City of Hobart - Obtained pre-discovery dismissal for lack of personal jurisdiction in § 1983 action where Plaintiff sued an Indiana municipality and police detective in Illinois federal court for false arrest. Dismissal was affirmed on appeal.
Satinoff v. City of Highland Park - Obtained pre-discovery dismissal on the basis of Section 3-106 of the Tort Immunity Act in personal injury action where Plaintiff alleged she sustained injuries upon tripping and falling on a curled up rug at the entrance of Defendant’s library. Dismissal affirmed on appeal.
Straw v. Village of Glendale Heights, et al. - In collaboration with a team of counsel representing several other local municipalities, obtained pre-discovery dismissal of Americans with Disabilities Act claim where Plaintiff alleged the condition of the Defendants’ public ways violated the Act, on the basis that the Plaintiff lacked Article III standing. Dismissal affirmed on appeal.
